Section 1: Access and Account

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your jurisdiction and you have given us your consent to allow any of your minor dependants to use the Services on devices you own, purchase, or manage.

To use the Services, including browsing our online store or purchasing products, you may be asked to provide information such as your email address, billing, payment, and shipping details. You represent and warrant that all information you provide is correct, current, and complete, and that you have all rights necessary to provide it.

You are solely responsible for maintaining the security of your account credentials and for all activity on your account. You may not transfer, sell, assign, or licence your account to any other person.

Section 2: Our Products

We take care to accurately represent our products online. However, colours and product appearance may differ from how they appear on your screen, depending on the device and settings you use. We do not warrant that product descriptions or other content on the Services are error-free.

All product descriptions are subject to change without notice at our sole discretion. We reserve the right to discontinue any product at any time and may limit quantities available to any person, geographic region, or jurisdiction on a case-by-case basis.

Section 3: Orders

When you place an order, you are making an offer to purchase. t leaf T reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until t leaf T confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as we may be unable to accommodate cancellation requests after an order is accepted.

If we do not accept, change, or cancel your order, we will attempt to notify you using the contact details provided at the time of ordering.

Returns and exchanges are subject to our Shipping and Returns Policy.

Section 4: Prices and Payment

All prices are in New Zealand dollars (NZD) and include GST. Prices, discounts, and promotions are subject to change without notice. The price charged will be the price current at the time of ordering, as set out in your order confirmation email. We reserve the right to correct any pricing errors on the website.

We accept the following payment methods for online orders:

• Credit and debit cards, Visa, Mastercard, American Express

Orders may also be placed by phone or email and paid by credit card or direct bank transfer. Orders paid by direct bank transfer will not be dispatched until payment has been received and cleared.

You represent and warrant that: (i) the payment information you provide is true, correct, and complete; (ii) you are duly authorised to use that payment method; (iii) charges incurred by you will be honoured by your payment provider; and (iv) you will pay all charges incurred, including any applicable shipping charges and GST.

Section 5: Shipping and Delivery

Online orders placed before 3pm on a business day are dispatched the same day. Orders placed after 3pm or on a weekend or public holiday will be dispatched on the next business day.

Full details of our shipping rates and estimated delivery times are available on our Shipping and Returns page. All delivery times are estimates only and are not guaranteed. We are not responsible for delays caused by third-party courier or postal services, customs processing, incorrect addresses provided by the customer, or events outside our control. We are unable to deliver to PO Boxes.

Nothing in this section limits any rights you may have under New Zealand consumer law in relation to goods that do not arrive or arrive in a damaged condition.

Section 6: Returns, Exchanges, and Refunds

Your rights under this section are in addition to any rights you have under New Zealand consumer law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Those rights cannot be excluded.

Faulty or Incorrect Items

If you receive an item that is faulty, damaged, or not what you ordered, please contact us at support@tleaft.co.nz as soon as possible. We will arrange a replacement or refund at no cost to you.

Change of Mind

We accept change of mind returns on unopened, undamaged items returned within 30 days of receipt. The cost of returning goods to us is your responsibility. Once we receive and inspect the item, we will arrange an exchange or refund. We will cover the cost of sending any replacement back to you.

Section 7: Consumer Rights

Nothing in these Terms limits or excludes any rights you have under New Zealand consumer law, including the Consumer Guarantees Act 1993 and the Fair Trading Act 1986. Where goods are purchased for personal, domestic, or household use, those statutory rights apply in full and cannot be contracted out of.

Section 8: Intellectual Property

Our Services, including all trademarks, brands, text, images, graphics, product descriptions, video, and audio, and the design, selection, and arrangement thereof, are owned by t leaf T Ltd or its licensors and are protected by New Zealand and international copyright and intellectual property laws.

These Terms permit you to use the Services for your personal, non-commercial use only. You must not reproduce, distribute, modify, publish, publicly display, or transmit any material on the Services without our prior written consent. All rights not expressly granted are reserved by t leaf T Ltd.

t leaf T's names, logos, product and service names, designs, and slogans are trademarks of t leaf T Ltd. Shopify's name, logo, and related marks are trademarks of Shopify. You must not use either party's trademarks without prior written permission.

Section 9: Optional Tools

You may be provided with access to tools offered by third parties as part of the Services, which we neither monitor nor have any control over. You acknowledge and agree that we provide access to such tools "as is" and "as available" without any warranties, representations, or conditions of any kind. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use of optional tools is entirely at your own risk and discretion.

Section 10: Third-Party Links

The Services may contain links to third-party websites. We are not responsible for examining or evaluating the content or accuracy of any third-party website. If you access these sites, you do so at your own risk. Complaints or questions regarding third-party products or services should be directed to the relevant third party.

Section 11: Relationship with Shopify

t leaf T is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with t leaf T. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and t leaf T, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with t leaf T.

Section 12: Privacy Policy

All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read these policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to provide and improve them. Information you submit may be transmitted to and shared with Shopify as well as third parties in other countries, in order to provide services to you. You represent and warrant that: (i) you own or have all rights to the Feedback you submit; (ii) you have disclosed any compensation or incentives received in connection with that submission; and (iii) your Feedback complies with these Terms. We may, but have no obligation to, monitor or remove Feedback that we determine to be unlawful, offensive, or otherwise objectionable, or that violates any party's intellectual property or these Terms. You are solely responsible for any Feedback you post and its accuracy.

There may occasionally be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, or availability. We reserve the right to suspend or terminate your access at any time if we determine you have violated these Terms.

This section applies if you use, allow, enable, or cause the deployment of an automated agent or AI tool ("Agent") to access, use, or interact with any Services. "Agent" means any software or service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, any person or entity without direct human supervision.

No Agent may access the Services unless, at all times, it identifies itself in accordance with the requirements below. No Agent may access the Services if we have requested it refrain from doing so. Agents must:

• Identify that requests are from an Agent and disclose the Agent name in the HTTP request user-agent string
• Not conceal or obfuscate that access is from an Agent
• Respond truthfully to any question seeking to determine if interactions are from a human or computer
• Not circumvent any measures intended to limit or control Agent access

We may terminate this agreement or your access to the Services at any time without notice at our sole discretion. You will remain liable for all amounts due up to and including the date of termination. Sections relating to Intellectual Property, Feedback, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law will continue to apply following any termination.

We do not guarantee that your use of the Services will be uninterrupted, timely, secure, or error-free.

Nothing in this section limits or excludes any guarantees, rights, or remedies you have under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986, which apply to consumer purchases and cannot be excluded.

Section 19: Limitation of Liability

To the fullest extent permitted by New Zealand law, t leaf T, our partners, directors, officers, employees, affiliates, agents, contractors, service providers, and licensors, and those of Shopify and its affiliates, shall not be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind, including without limitation, lost profits, lost revenue, lost savings, loss of data, replacement costs, or any similar damages, whether based in contract, tort (including negligence), strict liability, or otherwise.

Nothing in this section excludes or limits any liability that cannot be excluded under the Consumer Guarantees Act 1993, the Fair Trading Act 1986, or any other applicable New Zealand law.

You agree to indemnify, defend, and hold harmless t leaf T, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities, or claims, including reasonable legal fees, arising from: (1) your breach of these Terms of Service; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.

If any provision of these Terms of Service is found to be unlawful, void, or unenforceable, that provision will nonetheless be enforceable to the fullest extent permitted by applicable law. The unenforceable portion will be deemed severed from these Terms, and that determination will not affect the validity and enforceability of any other remaining provisions.

Our failure to exercise or enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.
